The parties
agree as follows:
1)The TERM
of this rental shall be a total of __ nights. Dates

Tenant
shall be entitled to possession on the first day of the term
of this Rental,
and shall
yield possession to Landlord on the last day of the term of
this Rental,
unless
otherwise agreed by both parties in writing. Plan to arrive
around 4:00 p.m.
on your
check-in date if you wish. We ask that you plan to leave by
10:00 a.m.
on your
check-out date.Tenant shall occupy and use the Premises as a
vacation
home
unit. Tenant shall notify Landlord of any anticipated
extended absence
from the
Premises not later than the first day of the extended
absence.
2.)The PREMISES
is located at: 2301 S. Atlantic Av, Daytona Beach,Florida.
3.) The RENT
is $_____.00 for this contract, an additional $50.00
cleaning fee
plus 12.5% Florida Tax a $200.00 security deposit
payable as follows:
Payment in full with return of this signed contract.
4)
Reservation Policy:
Don’t let this language be intimidating. However,
we have learned that we have to be firm and clear to prevent
any misunderstandings.
We require the full fee ($_____.00) within 8 days of this
notice.

Unfortunately, failure to meet these terms may result in a
lost reservation.
Please stay in contact as much as possible about your plans.
If we do not
receive a signed contract from you with payment, t
he property will be listed again for the time period
specified.
5)
Cancellation Policy:
In
the event of cancellation of this contract,
refund of the advanced rental will be made only to the
extent that a
tenant can be found to occupy the vacated time reserved
under this contract.
If we are able to rebook the property, we will refund a
prorated share of the
rental fee for each day we are able to fill, less a $100
cancellation fee. T
he option of trading your time in for a later time may be
considered, based on availability.
Any increases in the fee (Fees are established in January of
each year and will be posted on the website)
will need to be paid.
6) $200.00 Cleaning/Damage/Security fee-
The security deposit is fully
refundable within thirty days of termination of occupancy
provided that
there are no long-distance charges on the phone bill, linens
are stripped
from the beds and placed in the laundry room, floors are
broom swept & vacuumed,
dishes done, and trash in proper receptacles. The house
should be left as
clean as you found it. Real and personal property are in the
same locations &
condition as when occupancy commenced, and all terms of this
agreement are met*.
Renter is liable for all replacements and repairs needed to
attain the same condition
as when occupancy commenced.
*Clean
condition means that all beds are stripped of their sheets
and
blankets/comforters are neatly folded on each bed.
*
Sheets and towels are placed in the bath room.
*Clean
condition means that the refrigerator is cleaned out and
wiped clean.
*Clean
condition means that the stove is wiped clean.
*Clean
condition means that all dishes are done and put away.
*Clean
condition means that all garbage is emptied and placed in
large
containers provided in woodshed hall by elevators
*If
cleaning needs to be done, then a minimum of 2 hours at
$20/hour
will be
assessed to you and taken out of your security deposit.
7)
UTlLITlES:
We will provide your water, heat, air conditioning electric,
You are responsible for all local and out-of-state long
distance calls made
during tenancy. Please bring a calling
card to use.
8)
RESTRICTIONS:
No Pets unless permission granted. We like pets and
understand that you may not want to
leave your pet at home.
Talk to us about your pet and an
exception may be made.
We require a well-behaved pet with no biting history.
Animals that bark when unattended will
not be permitted.
9)
NO SMOKING:
Absolutely NO SMOKING on the premises, no exceptions.
You
will be asked to leave immediately if there is a violation.
There
will be no refunds. This is a fire hazard as well as smelly.
Smoking on the balcony is an option provided butts and the
like are not left behind.
10)
ACCOMMODATIONS:
1 queen bed or 2 queen sized beds.
There are linens and towels on the
premises for your use.
11)
MAXIMUM NUMBER OF
OCCUPANTS:
We highly recommend that the
house is to be occupied by no more than
TWO or FOUR(2-4) persons at a maximum.
You will not be comfortable otherwise.
This contract is for 2-4 adults
We
have a use and replace system for consumables.
This
means if you use items, you should replace the items.
This
use and share system has worked well over the past few
years.
So use
consumables, replace consumables, leave consumables*.
Consumables = toilet paper, garbage bags, paper towels, etc.
The
place will be stocked with all the items you need except
food.
Now for the OTHER tough stuff:
A) Renter assures us that any tenant who violates any of
the terms of this Lease shall be
immediately denied occupancy
and shall remedy any damages or other
expenses that are caused
by the tenant and/or the tenant's
guest(s).
This agreement does not create a tenancy for the
property; you can be
removed from the property
without process of law if you do not depart at the
appropriate time.
B) RENTER agrees that any tenant who is found using drugs or
allows others to use illegal drugs or tobacco on the
premises
will be immediately denied continued
occupancy at these premises.
C) RENTER and/or their guests shall not annoy, endanger, or
inconvenience neighbors,
nor use the premises for any immoral or
unlawful purposes, nor violate any law or ordinance,
nor commit waste or nuisance on or about
the premises. We do encourage a good party,
but be mindful of others.
D) RENTER agrees that during the term of this rental and
such further time as he/she occupies
the premises, he/she will keep the
leased premises clean and free of trash, garbage, and other
waste;
and all pipes, wires, glass, plumbing
and other equipment and fixtures in the same condition as at
the beginning of, or may put in during the term of the
lease, reasonable wear and tear and damage
by unavoidable fire and casualty only
exception.
E) RENTER agrees to indemnify and save us harmless from all
liability, loss or damage arising
from any nuisance or harm made or
suffered on the rented premises by the RENTER, tenants,
or guests or from any carelessness, neglect, or improper
conduct of any persons entering,
occupying or visiting the rented
premises. In other words, use the property and its amenities
at your own risk and at your risk for your guests. We will
not be liable for damage to persons
or your property. By signing this agreement, you agree to
these terms.
Landlord and Tenant shall each be
responsible to maintain appropriate insurance
for their respective interests in
the Premises and property located on the premises
F) Renter agrees to not make alterations to property
including painting, chnaging locks or adding new ones.
G) Upon not less than 24 hours notice, RENTER shall make
available to us the premises of entering to make necessary
or convenient repairs. In an emergency, we or our “agent”
may enter the premises at any time without securing prior
permission from RENTER..
H) RENTER may not let, sublet or assign this lease for all
or any part of the premises.
I) If RENTER abandons or vacates the premises, we may at our
option, terminate this rental, enter the premises, and
remove all property.
J) In the event that any action shall be commenced by either
party arising out of, or concerning this rental or any right
or obligation derived there from, the prevailing party shall
be entitled to receive attorney's fees as fixed by the Court
in addition to all relief at law or equity.
K) Notwithstanding any other provision of this Rental,
Landlord may terminate
this rental upon thirty (30) days` written notice to Tenant.
Monies for remaining
lease period will be refunded within 31 days of termination,
less damages, if any.
L) RENTER assumes full responsibility for fulfilling the
terms of the rental for the period stated and assures us of
full recourse for the payment of any amount outstanding from
the total amount due in accord with the terms as stated
above including any outstanding or unpaid charges that are
the responsibility of the RENTER.
M)
In the event of cancellation of this contract, refund of the
advanced rental will
be made only to the
extent that a tenant can be found to occupy the vacated
time reserved under this
contract.
I have read all 5 pages of this contract and understand and
agree to all the terms within. My signature reflects a
binding agreement with the landlord, Renata Gozdziak.
